Homeschooly - Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Homeschooly, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App. These Terms form a legally binding agreement between you and Kinobo Studios Limited (“we”, “us”, “our”). We license use of Homeschooly to you on the basis of these Terms & Conditions. We (or our affiliates and/or third party licensors, where applicable) remain the owners of Homeschooly at all times.

2. Eligibility

To use Homeschooly, you must be at least the age of majority in your jurisdiction or have parental/guardian consent. By using the App, you confirm that you meet these eligibility requirements.

3. Subscriptions and Payments

To use Homeschooly, registration is not required, but to download and use the App you must sign in with your Apple ID or Google ID. Relevant rules of Apple Inc. and Google Inc. respectively located at: https://www.apple.com/itunes and https://play.google.com/store apply.

Homeschooly offers optional subscription plans that unlock premium content and features. Payments are processed securely through Apple’s App Store or Google Play billing systems. We do not collect or store any payment card information. Subscriptions automatically renew unless canceled at least 24 hours before the renewal date.

• You can manage or cancel subscriptions through your App Store or Google Play account settings.
• All billing, refund and payment issues are subject to the terms and policies of Apple or Google, as applicable. Homeschooly does not have access to your billing information and so cannot offer a refund. For Apple subscription purchases, refunds or any other issues regarding subscription please contact Apple Inc. For Google Play subscription purchases, refunds or any other issues regarding subscription please contact Google Inc.
• You can at any time choose to cancel your subscription through Google or Apple and your membership will still be valid for the subscription time you have paid for.

4. Use of the App

We are committed to ensuring that the App is as useful and efficient as possible. For that reason, we reserve the right to make changes to the App or to charge for its services, at any time and for any reason. We will never charge you for the App or its services without making it very clear to you exactly what you’re paying for. It’s your responsibility to keep your phone and access to Homeschooly secure.

Certain functions of the App will require the app to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider. We cannot take responsibility for the App not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left. If you’re using the App outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the App, or other third party charges. In using the App, you’re accepting responsibility for any such charges, including roaming data charges if you use the App outside of your home territory (i.e. region or country) without turning off data roaming. Along the same lines, you need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the service, Homeschooly cannot accept responsibility.

We accept no liability for any loss, direct or indirect, you experience as a result of relying wholly on the functionality of the App. At some point, we may wish to update the App. The App is currently available on iOS and Android – the requirements for systems (and for any additional systems we decide to extend the availability of the App to) may change, and you’ll need to download the updates if you want to keep using the App. We cannot guarantee that we will always update the App so that it is relevant to you and/or works with the iOS/Android version that you have installed on your device. We may also wish to stop providing the App, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the App, and (if needed) delete it from your device.If you are not the bill payer for the device on which you are using the App, please be aware that we assume that you have received permission from the bill payer for using the App. You agree to use Homeschooly only for lawful purposes and in accordance with these Terms. You must not:

• Reverse engineer, modify, or create derivative works based on the App.
• Use the App to transmit harmful, fraudulent, or illegal content.
• Attempt to circumvent subscription or access controls.

5. Intellectual Property

All content, design elements, and intellectual property within Homeschooly are owned or licensed by Kinobo Studios Limited. You are granted a limited, non-exclusive, non-transferable license to use the App solely for personal, non-commercial use. No other rights are granted unless expressly stated.

6. Third-Party Services

Homeschooly integrates with RevenueCat to manage subscriptions. By using the App, you agree to RevenueCat’s terms of service and privacy policy. Apple and Google also have their own terms governing in-app purchases.

7. Disclaimer of Warranties

Homeschooly is provided “as is” and “as available,” without any warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation of the App or that it will meet your specific needs.

8. Mood Tracking And Insights Disclaimer

The Homeschooly app allows parents and guardians to record and monitor their children’s moods and activities. Based on this information, the app may generate insights suggesting which activities appear to positively or negatively influence mood. All mood and activity data entered into the app is stored locally on the user’s device. Homeschooly does not collect, transmit, or have access to any personal or mood data. All insights and summaries are generated on-device, using only the information you choose to enter. The mood insights and recommendations provided by Homeschooly are intended for informational purposes only. They are not a substitute for professional medical or psychological advice. If you have concerns about your child’s wellbeing, you should seek guidance from a qualified healthcare professional. Homeschooly makes no guarantee regarding the accuracy, completeness, or usefulness of any insights or recommendations provided within the app. Users remain solely responsible for decisions or actions taken based on the information displayed in the app.

9. Limitation of Liability

To the maximum extent permitted by law, Kinobo Studios Limited and its affiliates shall not be liable for any indirect, incidental, or consequential damages arising from your use of or inability to use the App. Our total liability for any claim relating to these Terms shall not exceed the amount you paid for the App or subscription during the preceding twelve months.

10. Termination

We reserve the right to suspend or terminate your access to Homeschooly at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or the App.

11. Changes to Terms

We may update or modify these Terms from time to time. If changes are material, we will update the effective date above and provide notice within the App or on our website.

12. Governing Law

These Terms are governed by the laws of England and Wales. If you live outside the United Kingdom, you may also be protected by the mandatory laws of the country where you live. If a dispute arises, we hope you’ll contact us first at [email protected] so we can try to resolve it together. If we can’t reach an agreement, you may bring legal proceedings in the courts of England and Wales, or—if required by local law—in the courts of your home country.
